Research | 1873 | Research: Samuel Chamberlain = take care There is clearly a Samuel Chamberlain large boot and shoe manufacturer who presumably dies in 1873 (or goes bankrupt) and his business and home premises are sold off by auction. Judging by the items for sale, this is a significant and mature business (and not associated AFAIK with Lemuel Samuel) ... IN 1871 There is a Samuel Chamberlain of 96 Highcross Street age 29, Shoe Manufacturer (born Loughborough). He has a wife Lucy (age 27) and a daughter Sarah A (age 7) (make news in 1877 family living apart). Not the same as our Lemuel Samuel - but they both boot and shoe manufacturers (Shoe hand more precise for Lemuel's early days). I think Lemuel plays on this second christian name, unless this is a spelling mistake. What is really annoying is that this business was operating from 96 Highcross Street. In 1875, Lemuel is operating from 101 1/2 Highcross Street (home 24 Belvoir Street) Not at all confident in a link between the business of Samuel Chamberlain (died 1873), and Lemuel Samuel Chamberlain. Either commerically or genealogically. Note that there is also a Samuel Chamberlain, superintendent of registrar in the district of Leicester in 1870's (gives evidence in 1876 in a case against a bigamist). |

Failure of a Nottingham Wine Merchant An absent debtor A first meeting of the creditors of Arthur John Wyvill, of 8 Collin-street, and Greyfriars-gate, Nottingham, wine and spirit merchant, was held this morning, at the offices of the Official Receiver (Mr. H. R. Thorpe). There was a large attendance of creditors, both in person and by proxy - Mr. P. P. Truman appeared for Messrs. Charrington and Co., brewers, Burton-on-Trent, the petitioning creditors; Mr. Smith (from Messrs. Martin and Son) represented Messrs. Samuel Smith and Co.'s Bank; and Mr. A. Barlow was present on behalf of Mrs. Wyvill, the debtors wife. The official receiver said they approached the case with the usual difficulty, because the debtor had absconded, or, at least, he was not available for the purpose of giving any information with regard to the estate. Such information as he (the Official Receiver) had been enabled to get he had obtained from the debtor's books, or it had been communicated to him by solicitors and others who were interested in the case. It seemed that the debtor went into partnership with Lemuel Chamberlain in 21st September, 1887, and that that partnership was dissolved on 4th March 1889. Mr. Wyvill succeeded under that arrangement with Mr. Chamberlain to all the assets and liabilities at that time. The assets at that time were valued is such wise that Wyvill paid Chamberlain the sum of £350, which included £200 advanced by Chamberlain to the firm subsequent to the partnership, and therefore represented only the sum of £150. The assets included three properties, one at Hunger Hill-road, Nottingham, another at Hucknall Torkard, and the third at Uppingham, which were leased to Chamberlain and which were made over to him by Wyvill and sub-let by the latter to the various persons now occupying them. An interim receiving order was made, directing himself to take possession of the premises in Greyfriar-gate and in Collin-street, which was done. At the house in the last-named street a large portion of the furniture was claimed by Mrs. Wyvill, under a settlement or agreement made when she was in contemplation of marriage with Mr. Wyvill on 23rd April, 1878. The agreement was produced to him (the Official receiver) that Mrs. Wyvill was a lady who had at that time property of her own which was agreed to be settled upon her. A statutory declaration in proof of her claim had been made, and he had admitted her claim, and had left her in possession of that part of the furniture to which the claim related, and it had been valued by his broker. On the following day a receiving order was made. On that same day of the day after it seemed that a mare, which was the property of the bankrupt, and which was in a certain stable in town, was taken by a person who had been examined as a witness to a repository at Leicester, and sold for £15. The debtor himself had apparently stayed away from his business from the beginning of November, and the business had been carried on since that time by his wife and a book-keeper. He (the Official Receiver) had ascertained from their traveller that considerable sums of money amounting during the month of December to £40 had been received by him and paid over to one or the other of those two persons. He mentioned that in order that the creditors might see that whatever turn the bankruptcy took the person who carried on the business since November would have an account to render to the estate. The only other information that he could give was that as far as he could ascertain from the books of account the liabilities amounted to £1,687 13s 4d. The plant and stock, which was advertised for sale on ...might probably produce £100.0 The debtor had books ... amount to £612, of which up to that time there were only been received £40. If those book .... were taken at ten shillings they would make about £300. There was a quantity of goods which were distrained by the landlord in the Greyfriar-gate premises. For £17 10s, they were redeemed by the solicitor to the petitioning creditor. The portion that was left would only realise about £50, and about £30 would come to the estate. He had had a list made of 84 persons with whom about 660 dozen bottles and jars appeared to be outstanding, but he was afraid that the trouble and expense attending the recovery of these things would reduce their value to the estate considerably. Then there was a registered trademark on bottles of "champagne bitters." He had given notice to the Registrar of the fact, but he did not know whether that would be a profitable item. There was also 72 gallons of whiskey in bond, against which there stood a debt of £43 and a carriage account for £4 sent in by the Midland Railway Company. There would thus be £47 to set against a quantity of whiskey, which he roughly assumed to be of the value of £56. That so far as he was at present aware, was a summary of the assets and liabilities of the estate. It was a matter of great importance to the creditors that a trustee should be chosen who would be able to deal competently with the complications which surround the estate, and the further difficulties with which the estate had been involved by the circumstances that the debtor had thought fit to leave it for a month or six weeks to the care of those who had received and paid away amounts which it was necessary for the trustee to take into account. In answer to a question, the Official Receiver said he had very little to say with regard to the property assigned to Mr. Tidmarsh. There was a lease for seven years on property at Hucknall Torkard, at £40 a year from the 29th September 1885. That was leased to the present occupier, Mr. Tidmarsh, so recently as the 24th December last, in consideration of £5 paid to Mrs. Wyvill. He (the Official Receiver) had seen the document which purported to be the assignment of the lease, but, in his judgement, it was not valid. He was told that some money was paid by Tidmarsh either to Mrs. Wyvill or Mr. Adams. He had since heard that the money had been repaid by Mrs. Wyvill or Adams under circumstances of which at present he knew nothing. Mr. Truman remarked that they had been very fortunate in having been so soon able to appoint an interim receiver. If goods had been removed from the debtors's's premises it would have to be shown whether the persons to whom they were taken were creditors of the debtor or not. he had paid the rent out in order to avoid a forced sale of the goods, but he was surprised to see that in spite of his efforts the goods were sold subsequently in pretty much the same manner as he had wished to prevent. He did not know why the sale should have been so precipitate. They had been enabled after some difficulty to obtain the cash-box and a number of books relating to the business, they having been discovered under Mrs. Wyvill's bed. Mr. A. Barlow here remarked that Mrs. Wyvill had given every information in her power with regard to the estate. Mr. Truman proposed that they should appoint Mr. Charles Marshall trustee of the estate, for had it not been for that gentleman they would have found the estate in a less satisfactory condition than it was at present. Mr. Rook seconded the resolution. An amendment was moved by the Official Receiver, as proxy for Smith's Banking Co., at the request of Mr. Smith, that Mr. R. Rhodes, of the firm of Rhodes and Hallam, Nottingham, be appointed trustee. The amendment was carried, creditors to the amount of £808 3s. 9d. voting for Mr. Rhodes, and those to the amount of £594 2s. 2d. supporting Mr. Marshall. Mr. Truman asked the Official Receiver if he could not corroborate the statement that Mr. Marshall had been of considerable assistance to him in the present case? The Official Receiver said he could and was happy to do so. Mr. Truman said the matter was entirely in the hands of the creditors, and they had chosen whom they liked as their trustee. The result of the voting, however, would be a lesson to Mr. Marshall not to take the chestnuts out of the fire either for the Official Receiver or a Trustee. At present, Mr. Marshall must be thankful for what he had not got, but he would ask the creditors to give instructions to the trustee to pay Mr. Marshall for his services. The Official Receiver had great pleasure in again saying that Mr. Marshall had rendered considerable service to himself in giving him information which he could not have otherwise obtained. As far as he could see he intended to render every service to the estate. He had great pleasure in bearing testimony to the fact that Mr. Marshall, from the time the interim receiving order was made up to the present, had rendered every assistance in his power. His (the Official Receiver) feeling was that it would be a proper thing to make Mr. Marshall some recognition. The committee of inspection was elected as follows: Messrs. R. F. Watson, J. Press, G.A. Buttifant (sic - should that be Bullivant?), G. W. Downing, and T. G. Mellors. It was resolved, on the motion of Mr. Truman, that the sum of five guineas be given to Mr. Marshall for his service to the estate.31 |

Wyvill's wife, brother and someone named "Harker" or "Adams" variously were charged with conspiracy to defraud - items were removed from the debtors estate by them acting "on behalf of the business" but in fact asset stripping it with no authority to do so (depriving debtors of their due funds). His brother E.C. Wyvill was let off (on 31 Oct 1890) as it looked like he genuinely tried to run the business for a while, the other 2 sent to trial at the next assizes. Research* | Research: Number of children. In 1911 census it is stated that William and Harriett had 8 children, 6 of whom have died. So far, I have only found 4 of the 8. The family wasn't exactly keen on baptiism either. May have had children born and buried between census. Lots of Chamberlain's born in Leicester and Nottm during his tenure, so could be any of them. It is also possible that some were stillbirths which went unrecorded? Fortunately, GROonline now has mother's maiden name, and Welford Road burials includes stillbirths ... so all angles are covered, and all children accounted for. | |

Philip Raynor Charlton1

Research* | Research: Early in 1928 Ann and Molly sailed to Freemantle on the SS Benalla (P & O). Their UK address is given as Kneeton House, East Bridgford, Nottinghamshire, which suggests they had stayed in the area after their mother's death. On board ship Molly met Phillip (Raynor) Charlton, "a fine military gentleman", although described on the passenger list as a 25-year-old bootmaker, of Hall House, West Boldon, Durham. Ann & Molly returned to Plymouth (again on the SS Benalla) with their ill brother Robert William (listed as a "grazier"), all giving Kneeton House as their intended destination. In November 1929 Phillip Charlton returned from Australia - he is listed this time as a "bank clerk" and he too gave Kneeton House as his intended destination - and almost immediately married Molly in London. The marriage took place on 10 December 1929 at the St Giles District Registry Office, Bloomsbury. The certificate gives his age as 27 and hers as 43 and records their residence as 50 Bloomsbury Street. (Today this is an area of hotels and in the 1911 Census no. 50 was a small boarding house.) It lists his profession as "book keeper". Phillip Charlton's father is given as Patrick Charlton, a "master saddler" - although he seems to have come late to the profession: his employment is given in the censuses from 1881 through to 1911 as coalmining, as a miner in 1881, a colliery labourer in 1891, a coal screener in 1901 and in 1911 (aged 51) as a banksman. He was most likely born in 1860, registered in Morpeth in the Apr-Jun quarter. Exactly where isn't clear: it's slightly different in every census he appears in. In 1861, aged 1, he was at the village of Guide Post, near Morpeth, Northumberland and his birthplace was recorded as Bothal. He was with his parents James (36) & Mary (40), both born in Ireland, and his sister Bridget (11). His father was working as a brickyard labourer. The 1871 Census found the family at Westoe, South Shields: James (46), listed as Thomas J., and Mary (46)(!), Patrick (now 11 and born this time in Guide Post), his new brother James (5), 5 boarding Irish labourers and one servant. Bridget seems to have got married in 1869. The family were in Eighton Banks (Gateshead) in 1881, with Patrick's birthplace given as Morpeth. He was working as a coal miner, as were both his parents and his brother. By 1891 Patrick had got married, probably about 1884 (although I cannot trace a formal record), to Elizabeth Riley, who seems to have been born in Houghton-le-Spring, County Durham, in early 1866. (Her father was John Riley and was living with them in 1891 so presumably he was a widower by then, although the census simply states him as single.) I have not identified her parents for certain but the likeliest pair (John & Mary) were both born in Ireland. If so, in 1881 they were living at Escomb, Co. Durham. Elizabeth was 15 and working as a domestic servant. She had four younger sisters and a younger brother. It's possible Mary died in early 1887 or late 1886. I have not found them in earlier or later censuses.) Patrick was working as a colliery labourer (born this time at North Seaton), living at Boldon, County Durham, with his wife and 4 children (Mary, 5, Thomas, 4, John, 2, and Joseph, 2 months). Ten years later for the 1901 Census, they were at 27 South View Terrace, Harton, Co. Durham. Patrick (this time born at Newbiggin) was a coal screener (who separates larger and smaller pieces of mined coal with a 'screen'). Son Thomas (14) had started working as a pony driver at the mine. And there were 5 more children, Hannah (8), Hilda (6), Florence (5), Ruth (3) and William (1). In 1911 the family, with the addition of Philip (he seems to have added the second 'l' himself later), aged 9, and Nelly, aged 7, were at Hall House, West Boldon, South Shields (the address Phillip gave on the 1928 passenger list to Australia). Patrick (now 51) this time was born in Blyth, Northumberland and was working as a coal mine banksman (who, I believe, operated the cages that took miners up and down). It has not been possible to establish when Elizabeth or Patrick died. The 1911 Census records that Patrick and Elizabeth had then been married for 27 years and had had 12 children, one of whom was already dead, so one further child remains unidentified through the censuses. All Patrick's places of birth are in a relatively small area, a triangle of about 15 square miles in Northumberland, and given some vagueness about ages also one must assume that the Charltons were not wholly reliable census informants. It seems safe to say that Phillip emerged from a large, relatively humble, working family with a strong Irish background. Apparently Molly and Phillip didn't live together much until he became too sick to go "galavanting" [as she described it according to my mother]. For instance in Oct 1931 he sailed (describing himself now as a "farmer") to Cape Town returning almost immediately in December. Ann and Molly both moved to Port Eynon and Phillip ended up there too. He died aged 60 on 26 October 1962 (from "cardiac failure, coronary thrombosis and bronchitis") at Molly's home, Abberley Cottage, Overton. The death certificate gives his occupation as "stores overseer".2 | |

Basford This appears to be cousins marrying each other. As far as I can tell, their respective mothers were sisters. I wonder if any Leivers witnessed the marriage?1 |
