Shire Hall Nottingham Saturday - John Crooks, beerhouse-keeper, Kimberley, appeared to answer a summons charging him with having kept his house open for the sale of ale during the hours of divine service, on Sunday morning last. Mr. Coope attended to watch the case for defendant. Police-constable Hill said that at half past eleven o'clock on Sunday morning last, he went to defendant's house and found three men drinking. Mr. Coope admitted the facts, but contended that the defendant was bound to supply the men with refreshment as they were travellers. He called two of the men, who stated that they had walked to Nottingham from Codnor Park and Beggarlee that day, and that they were on their way back when they called at the defendant's house, having walked fifteen miles. The magistrates thought that the men be considered travellers and dismissed the case.12 |

Shire Hall Nottingham Intimidation John Morris was charged with using threats to George Dickinson, at Kimberley, on Thursday night last. The complainant, a person of rather weak intellect, is a collier in the employ of Mr. North, and was leaving work on the night in question, when the defendant called him a "black leg" and threatened to cut his eyes out. The threats, it was alleged, were used in consequence of the complainant having gone to work whilst the rest of the men were out on strike. The complainant's father deposed to hearing the defendant call his son a "black leg" and threatening to cut his eyes. This was not the first nor second time time that the defendant had uttered similar threats. Robert Rhodes, a youth called by the defendant said he was in company with the defendant on the night in question, and on passing the complainant he said to him (witness) "If I were thee I wouldn't go to work until the rest goes in, of they will call thee black leg". No threats were applied to the complainant. John Crooks another witness called, said that the defendant did not say a word to the complainant, his conversation being directed to Rhodes. The complainant said that after the occurrence, Rhodes came to his father's house and begged him not to "law" the defendant. The magistrates ordered the defendant to enter into his own recognizances of £20 to find two sureties of £10 each, and to pay the whole of the expenses. (it must be noted that John Crooks ran a pub called the "Jolly Collier", so was likely to back his main/future source of income even if they were on strike).17 |

Kimberley Suicide An inquest was held at the Lord Nelson, Kimberley, on Monday last before C Swann, Esq., coroner, touching the death of John Wilkinson, a pensioner aged 67 years, who committed suicide by hanging, the previous day. The deceased was a discharged pensioner and had been blind for upwards of 40 years. He had for a long time been in a desponding state of mind, and had a religious melancholy. He married his second wife about a year ago, and the marriage being an unhappy one, they separated and since that time, the deceased has lived in the house of his son-in-law, Mr. John Johnson Crooks. He went up stairs about seven o'clock on the Sunday, as supposed for the purpose of going to bed; but at about nine o'clock he was found hanging and quite dead. He hung himself to one of the bed posts with his handkerchief and when found his feet were resting on the floor. Verdict was that the deceased hung himself whilst in a state of unsound mind.20 |

Clay Cross Important Decision of the Arbitration Committee of the Bagthorpe District of the Ancient Order of Foresters. On Saturday afternoon the above committee was summoned to decide an appeals case, Brother Geo. Allen v, court "Sherwood Ranger" no. 1647 of the A.O.F. The following were present, vis. Bros. James Purdy, Bagthorpe; William Johnson Clay Cross; Henry Wilson, Brinsley; William Rawson, Swanwick; J. Burch, Ripley; Luke Briggs, Tupton; John Johnson Crooks, Kimberley; Joseph Pedley, Newthorpe; and George Smith, Langley Mill. They met at the seat of the district for the year, viz. Court 2575, Durham Ox Inn, New Brinsley. Bro. Crich D.C.RF. presided. The following facts of the case were adduced - Bro. George Allen is a member of Court 1647 and lives at Butterley, near Alfreton. On the 30th March he met with an accident whilst working for the Butterley Co. He applied to his Court for the weekly allowance, and a surgeon's certificate, but the officers refused to pay the same on the grounds that Allen was unfinancial through not paying 2s. that was due on the previous court night, towards the surgeon's fee. The order possesses means to settle all such cases without the interference of courts of justice, and hence the present appeal to the district officers was made. The officers met (on June 9th) according to law, and inquired into the case, and then called the committee to try the case. Evidence was given by Brothers Neal and Johnson of Somercoates, on behalf of the court showing that Allen knew, both before and after the accident, that he was suspended by not paying the 2s fee to the surgeon on the first court night in March. On the other hand. Allen contented that he did not know that he was suspended, and referred to the general law, which says that prior to being suspended he shall have notice sent of the same to his last known address. Such notice had not been sent; but the court contended that the wife of a member had told Allen that he would be suspended on such a day if the 2s. were not paid. ... Neal, C.R. of Court 1647, admitted taking 8s. to Allen on condition that no further steps were taken... A deal of discussion took place relative to the undecisive way in which several bye laws of the court bearing on the point were worded. Ultimately, the room was cleared of all but the president and the committee, and after one hour and a quarter's deliberation they came to a decision to the following effect, viz: That Brother George Allen of the court of 1647 is fully entitled to the full amount of his sick allowance from the funds of his court, with the exception of the first three days of his lameness, he forfeiting them through not giving proper notice to the treasurer of his accident. The committee grounded their decision on General Law 80a, Sec 2, and Bye Law 33, both of which say that before a member can be suspended he must have proper notices sent to him. The committee also said that a deal of trouble and expense might have been saved if the officers of the court had called their own arbitration meeting, according to Bye-Law 8. The court to pay all expenses. On the decision being made known, Neal, on the part of court 1847 said he should appeal to the high court of the order against the decision.24 |
